Appeal Court adjourns Kano LG election case

Published on March 25, 2025 at 10:36 AM

The Court of Appeal in Abuja has scheduled April 8, 2025, for the hearing and determination of cases related to the local government elections conducted in Kano State’s 44 Local Government Areas.

The appellate court fixed the date on Monday after addressing multiple motions filed alongside the main case.

The Kano State House of Assembly had approached the court, seeking to overturn the judgment of the Federal High Court in Kano, which had barred the conduct of the elections since October 2024.

Represented by Senior Advocate of Nigeria (SAN) Adegboyega Awomolo, the House of Assembly argued that the Federal High Court lacked jurisdiction to intervene in matters concerning local government elections in Kano State.

They contended that the suit filed by Aminu Aliyu Tiga and the All Progressives Congress (APC), was already statute-barred at the time of filing and that the plaintiffs lacked the legal standing to initiate the case.

Justice Simon Amobeda of the Federal High Court had on October 22, 2024, restrained the Kano State Independent Electoral Commission from conducting elections for chairmen and councillors in the state’s 44 LGAs until all legal requirements were met.

Dissatisfied with the ruling, the Kano State House of Assembly filed a case at the Court of Appeal, urging it to nullify Justice Amobeda’s judgment.

They insisted that the organization of local government elections falls exclusively under the jurisdiction of the Kano State Government and that only the Kano State High Court has the authority to adjudicate on matters relating to the election, not the Federal High Court.
